Full Terms and Conditions
Price Quotation: The Artist will provide the Client with a written quotation of the requested artwork. This quotation includes the cost of art supplies, estimated hours of work, and any additional charges that may apply. Shipping & Handling is listed separately. Prices are subject to change based on the complexity of the project, but will be agreed upon before commencement of work.
Acceptance of the Commission: Acceptance of the commission must be made in writing (email is acceptable). By accepting the commission, the Client agrees to these Terms and Conditions.
Booking Fee: A non-refundable booking fee of 50% is required to secure the commission and begin work. This booking fee will be deducted from the final payment.
Photo Provision: For commissions based on photographs, the Client must provide high-quality, clear photos. The quality of the commissioned piece is directly related to the quality of the provided photograph. The Artist reserves the right to reject any photo that does not meet the necessary quality standards.
Commission Process: Line art will be submitted to the Client by the Artist for approval at the beginning of the Commission Process. Once approval is given by the Client and the Artist begins the colored pencil portion of the work, no changes can be made to the Portrait.
Copyright: The Artist retains copyright to the commissioned artwork from the Client’s photo. The Artist reserves the right to share on their social media and website. This means prints and mock-ups can be made from the commissioned artwork.
Time Scale for Portrait: The completion time for a commission varies and is dependent on the Artist’s current workload, the complexity of the commissioned piece, and the size of the artwork. An estimated completion date will be provided when the commission is accepted. However, this is an estimate and not a guarantee. The Artist will ensure they communicate regularly with the Client to keep them up to date with their commission. If the finished piece is for a time-sensitive occasion, such as a birthday, please inform the Artist in case special time accommodations can be made.
Balance Payment: The balance of the payment is due upon completion of the artwork, before shipping or delivery. The artwork will not be shipped or delivered until final payment has been received. Payment is taken via PayPal, Credit Card, or Invoice. Personal Checks are accepted with prior approval from the Artist. Cash payments are only accepted via in-person transactions.
Sales Tax: Sales tax is not included in the quoted prices listed on the Artist’s website. Sales tax will be included in the final total as detailed in an itemized invoice from the Artist.
Shipping: All final pieces will be securely packaged to ensure safe delivery. Finished works are shipped via FedEx or UPS, and a tracking number will be provided to the Client. A flat $40 Shipping & Handling fee applies to all commissions, which covers both packaging materials and shipping costs within the continental United States. At this time, the Artist does not ship internationally. If international shipping becomes available in the future, costs will be quoted separately. If the commissioned portrait is a gift, the Client must provide the correct shipping information in writing.
Framing: Framing is the Client’s responsibility unless otherwise agreed. If the Client would like the final work framed, it may be transferred to Deselms Fine Art & Custom Framing. All framing details, including style, cost, and timeline, will be handled directly between the Client and Deselms Fine Art & Custom Framing.
Sharing on Social Media: The Artist reserves the right to share the commissioned artwork on social media and for portfolio purposes, unless specifically requested otherwise by the Client in writing.
Termination of Commission Request: The Client may terminate the commission request within 7 days of the initial deposit payment. In such cases, the deposit will not be refunded but may be applied to future commissions. If the Artist must cancel the commission due to unforeseen circumstances, the deposit will be fully refunded to the Client.
